Terms of ServiceThe rental agreement, in plain language
These terms cover how rentals and charters with Boat Rental San Diego work: booking, cancellations, what we ask of renters, and how safety and liability are handled. Reach us any time at (844) 461-2372 or hello@boatrentalsandiego.com.
How do bookings and deposits work?
A reservation is confirmed once you accept a quote and complete the deposit or payment shown on your booking link. Rates depend on the boat, the date, and your group size, and the price you confirm at booking is the price that holds. A card on file may be required to cover fuel, cleaning, or damage beyond normal use. Any balance is due before departure unless we agree otherwise in writing.
What if I cancel, or the weather turns?
If you need to cancel or reschedule, contact us as early as you can; the refund or credit that applies depends on how much notice you give and is spelled out on your booking confirmation. Safety comes first on the water. If conditions are unsafe, we may delay, shorten, reroute, or cancel a trip, and in that case we work with you on a reschedule or a fair credit or refund for the affected time.
What is expected of renters?
Whoever books and whoever operates the boat agrees to run it responsibly, follow all posted rules and California and Coast Guard regulations, and keep every guest safe. A few basics that always apply:
- Operate the boat only in permitted areas and within any speed, capacity, or route limits we set.
- Never operate a boat while impaired by alcohol or any other substance.
- Stay within the guest capacity listed for your boat and keep children supervised at all times.
- Return the boat on time and in the condition it left, aside from normal wear.
Do I need a boater card or a minimum age?
Anyone operating a boat may need to carry a California Boater Card and meet a minimum age, as required by California law, and the exact rule depends on the operator's age and the boat. A valid government-issued photo ID is required to rent. Tell us who plans to drive and we'll confirm what you need before your date. If you'd rather not deal with any of this, we run captained boats.
What safety equipment comes with the boat?
Every boat leaves with the safety equipment California and the Coast Guard require, including life jackets sized for your group, and you'll get a short safety rundown before departure. Life jackets must be worn where required and kept aboard the whole trip. If any gear is missing or damaged when you board, tell us right away so we can make it right before you head out.
Who is responsible for damage or loss?
The renter is responsible for loss of or damage to the boat, its equipment, and any third-party property that results from use during the rental, up to the limits allowed by law. Report any accident, damage, or injury to us as soon as it's safe to do so. To the fullest extent California law allows, Boat Rental San Diego is not liable for indirect or consequential losses, and our liability is limited to the amount paid for the rental.
What risks am I accepting?
Boating carries inherent risks, including changing weather, water and wildlife conditions, equipment operation, and the actions of other vessels. By renting or joining a trip, you acknowledge those risks and agree that you and your guests take part voluntarily. Anyone with a health condition affected by boating should check with a doctor first, and a signed waiver may be required before departure.
Which laws govern these terms?
These terms are governed by the laws of the State of California, and any dispute will be handled in the courts serving San Diego County. If any part of these terms is found unenforceable, the rest stays in effect. We may update these terms from time to time, and the version posted here is the one that applies. Questions?
